Welcome to Globashare.

Introduction

When you browse or create an account on Globashare you accept these terms and you agree to follow these legally binding rule rules detailed here in these terms, so kindly read and understand them. Should you not agree with our terms, you should stop using the Globashare.com altogether. Use of Globashare is conditional on your acceptance of our User Terms, whether you become a registered user or not. You’re also agreeing to our Privacy Policy and Cookie Policy and agreeing to follow any other rules on the Site.

Key Terms

  • In this document when we say: ‘we’, ‘us’, ‘Globashare’ or ‘Globashare.com’ – we are referring to the owners responsible for Globashare.com, i.e. Globashare Ltd.
  • Sellers - are users who offer items and perform services through Globashare.
  • Buyers - are users who purchase services on Globashare.
  • Share Page - is the term that refers to a Globashare web page where sellers offer their work for sale or consumption.
  • The Freelance Centre - is where Buyers may post freelance jobs that sellers may apply for and subsequently deliver work for.
  • Orders - are the formal agreement between a buyer and seller after a purchase was made from the seller’s Share Page.
  • Freelance Job “Agreements” - are the contracts accepted by the buyer and seller – prior to starting a freelance job - that specify the rules and details of their contract
  • Job Work Space - is where buyers and sellers communicate with each other and deliver ordered Products or Services, in conjunction with a Freelance Job or Service Share Page
  • Disputes - are disagreements experienced during an order between a buyer and seller in conjunction with a Freelance Job or Service Share Page
  • Reports - are when a user reports to Globashare information on what they believe to be a breach of the rules set out buy Globashare or are seeking a refund for items purchased through Globashare’s marketplace
  • Revenue is the money sellers earn from completed orders.
  • Share Page Extras are additional services offered on top of a Seller’s Service Share Page.
  • Share Page Tile is the box representing their share page as it appears on the Globashare Marketplace

Sellers basics:

  • Users may offer Products, Information and Services through Share Pages listed on the Globashare.com marketplace
  • Users may also offer the services through Globashare’s Freelance centre
  • Registration is free.
  • Basic Users are allowed to post their content for a maximum selling price of $100 - Higher item prices are available to Bronze, Silver and Gold Level Users – see Upgrading and membership tiers
  • See Fees and Pricing below on Globashare’s commission rates
  • Globashare accredits Sellers once an order is completed.
  • If an order is cancelled (for any reason), the funds paid will be refunded to the buyer’s Shopping Balance.
  • Revenues are only made available for withdrawal from the Money & Transactions page following a safety clearance period of 14 days after the order is marked as complete.
  • Sellers may withdraw their revenues using one of Globashare’s withdrawal options.
  • Globashare retains the right to use all publicly published delivered works for Globashare marketing and promotional purposes.
  • The seller's rating is calculated based on the order reviews posted by Buyers
  • For security concerns, Globashare may temporarily disable a seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behaviour reported by Buyers, or associating multiple Globashare accounts to a single withdrawal provider.
  • Sellers are responsible for paying any direct or indirect taxes, including any GST, VAT or otherwise, which may apply to them depending on residency or location. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. A share page price shown on a share page is NOT inclusive of all such taxes and charges that may apply to the Sellers.

Buyer basics:

  • You may not offer direct payments to Sellers using payment systems outside of the Globashare Order system.
  • Buyers are protected by Globashare’s Payment protection and refunds policy – See below
  • Globashare retains the right to use all publicly published delivered works for Globashare marketing and promotional purposes.
  • Buyers can purchase any displayed items on Globashare Marketplace and may request Freelance Jobs from Globashare’s Freelance Job Centre.
  • Buyers payments are held, are only made available for withdrawal by the seller following a safety clearance period of 14 days after the order is marked as complete.
  • Items, services and jobs may be purchased using one of the following payment methods: Credit Card, PayPal or Globashare Credit.
  • Service fees are added at the time of purchase where a buyer can review and accept the total amount requested to pay. These fees cover administrative fees. As of May 2018, the current fees assessed to the total purchase amount are $2.5
  • If you have funds in your account balance, it will be automatically applied to your next purchase.
  • You may not offer Sellers to pay, or make payment using any method other than through the Globashare.com site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support here.
  • To protect against fraud, unauthorized transactions (such as money laundering), claims or other liabilities, we do not collect credit information; but allow our payment vendors to collect information for the purpose of collecting payments from Buyers on the Site or transferring payments to Sellers on the Site. We are not exposed to the payment information provided to our payment vendors, and this information is subject to the privacy policy applicable to the payment vendor. Please see our Privacy Policy for more information here.

About creating an account

Age: You must be 18 years or over to become a member of Globahsare.com. If you’re under 18 you will need to use the account of a parent or legal guardian who is at least 18 years of age, with their permission, and this adult will be responsible for all your activities. If necessary, we may ask you for proof of age.Sellers may only have one single account associated to a single withdrawal provider. Creating multiple accounts is forbidden at part of our terms

Your responsibility: You promise that information you give us is true, accurate and complete and that you will keep your account information up-to-date (including a current email address). Your membership is not transferable. You are responsible for any use of Globashare.com that occurs in conjunction with your username and password so keep your password secure and don’t let any other person use your username or password. If you realise there’s any unauthorized use of your password or any breach of security you need to let us know immediately. If you don’t follow these rules, we may cancel your account.

How Globashare works

Globashare is a transaction platform provides that promotes trust a reliability between buyers and sellers. When a seller posts a service or project on Globashare, they are inviting buyers to form a contract with them. Anyone purchasing a service or a product is accepting the sellers offer and forming that contract.Globashare is not part of that contract – the contract is a direct legal agreement between the buyer and seller. Here are the terms that cover this agreement:

  • When a product or service is made available for purchase the sellers are obliged to provide their offering “as described” and as pictured by the seller in their offer’s or share page’s.
  • Their offerings must be up to date, offer the latest versions or other versions pre-agreed upon
  • Both parties must respond to questions as quickly as possible. Failure to respond to communications may result in user’s defaulting on their obligations under these User Terms
  • Sellers should work diligently and in good faith to bring a job, service or product to the best possible conclusion in a timeframe that’s communicated to their buyers
  • The seller is solely responsible for fulfilling the promises made on their Share Pages and freelance centre agreements. If they’re unable to satisfy the terms of this agreement, they may be referred to Globashare Dispute resolution team and may have their account terminated.
  • If a seller is unable to complete their offering and fail to live up to the basic obligations of this agreement. To right this, they must make every reasonable effort to find another way of bringing their offering to the best possible conclusion for buyers.
  • A seller in this position has only remedied the situation and met their obligations to backers if:
    • they post an update and explains what work has been done,
    • they work diligently and in good faith to bring the offering to the best possible conclusion in a timeframe that’s communicated to their buyers
    • they’ve been honest, and have made no material misrepresentations in their communication to their buyers
  • The Seller is solely responsible for fulfilling the promises made in their offerings. If they’re unable to satisfy the terms of this agreement, they may be subject to legal action by their buyers.

Your use of the Globashare website

This below section is a list of basic rules that should not be broken

  • Don’t break the law. Don’t take any action that infringes or violates other people’s rights, violates the law, or breaches any contract or legal duty you have toward anyone.
  • Don’t lie to people. Don’t post information you know is false, misleading, or inaccurate. Don’t do anything deceptive or fraudulent.
  • Don’t offer prohibited items. Don’t offer any rewards that are illegal, violate any of Globashare’s policies, rules, or guidelines, or violate any applicable law, statute, ordinance, or regulation.
  • Don’t victimize anyone. Don’t do anything threatening, abusive, harassing, defamatory, libellous, tortious, obscene, profane, or invasive of another person’s privacy.
  • Don’t spam. Don’t distribute unsolicited or unauthorized advertising or promotional material, or any junk mail, spam, or chain letters. Don’t run mail lists, listservs, bots, or any kind of auto-responder or spam on or through the Site.
  • Don’t harm anyone’s computer. Don’t distribute software viruses, or anything else (code, films, programs) designed to interfere with the proper function of any software, hardware, or equipment on the Site (whether it belongs to Globashare or another party).
  • Don’t abuse other users’ personal information. When you use Globashare you may receive information about other users, including things like their names, email addresses, and postal addresses. This information is provided for the purpose of participating in a Globashare project: don’t use it for other purposes, and don’t abuse it.
  • Don’t try to interfere with the proper workings of the Services.
  • Don’t bypass any measures we’ve put in place to secure the Services.
  • Don’t try to damage or get unauthorized access to any system, data, password, or other information, whether it belongs to Globashare or another party.
  • Don’t take any action that imposes an unreasonable load on our infrastructure, or on our third-party providers. (We reserve the right to determine what’s reasonable.)
  • Don’t use any kind of software or device (whether it’s manual or automated) to “crawl” or “spider” any part of the Site.
  • Don’t take apart or reverse engineer any aspect of Globashare in an effort to access things like source code, underlying ideas, or algorithms.

Content guidelines: prohibited and objectionable content

Globashare does not accept content that is offensive, insensitive, upsetting, intended to disgust, or in exceptionally poor taste.
Examples of Prohibited and Objectionable Content include:

  • Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups, particularly if the app is likely to humiliate, intimidate, or place a targeted individual or group in harm’s way. Professional political satirists and humorists are generally exempt from this requirement.
  • Realistic portrayals of people or animals being killed, maimed, tortured, or abused, or content that encourages violence. “Enemies” within the context of a game cannot solely target a specific race, culture, real government, corporation, or any other real entity.
  • Depictions that encourage illegal or reckless use of weapons and dangerous objects, or facilitate the purchase of firearms.
  • Overtly sexual or pornographic material, defined by Webster’s Dictionary as "explicit descriptions or displays of sexual organs or activities intended to stimulate erotic rather than aesthetic or emotional feelings."
  • Inflammatory religious commentary or inaccurate or misleading quotations of religious texts.
  • False information and features, including inaccurate device data or trick/joke functionality, such as fake location trackers. Stating that the app is “for entertainment purposes” won’t overcome this guideline. Apps that enable anonymous or prank phone calls or SMS/MMS messaging will be rejected.

Getting your work, services and job requests reviewed and authorised

When you upload content for sale, a service offering, or post a freelance job, Globashare will first review your uploads and posts to verify the following pre-requisites. Please note: Globashare has the exclusive right to reject or accept all user submissions:

Make it clear and meaningful - Only the best sellers and items pass our review process. The most successful buyers and sellers put as much love into describing and presenting their work as they do in creating them. Give as much information as you can. Let other parties know exactly what you are offering, in every detail you can think of. This way you will gain more sales and keep your disputes and refunds down to a minimum.

Safety - Globashare will check your offering for prohibited and objectionable content as listed above.

Quality and Performance - Globashare reserves the right to ensure that buyers on Globashare’s marketplace get a quality and performant experience. To this end Globashare will accept or reject submissions

Business - There are many ways to monetize on Globashare. If your business model isn’t obvious, make sure to explain it well. If we can’t understand how your offering works, it will delay your review and may trigger a rejection. And while pricing is up to you, we won’t accept offerings that are clear rip-offs. We’ll reject expensive offerings that try to cheat users with irrationally high prices.

Design – Globashare customers place a high value on products that are simple, refined, innovative, and easy to use, and that’s what we want to see on the Globashare marketplace.

Legal – and Offerings on Globashare must comply with all legal requirements around the world and especially where you are located (if you’re not sure, check with a lawyer). It is the end user’s responsibility to understand and make sure your offerings conform with all local laws. And of course, offerings that solicit, promote, or encourage criminal or clearly reckless behaviour will be rejected. In extreme cases the appropriate authorities will be notified.

Keeping your work, services and job requests available on Globashare

Even after your offering has been approved, you should update your offering to ensure it remains functional and engaging to new and existing customers. Offerings that are clearly out of date or offer a degraded experience or create no sales for extended periods of time may be removed from the marketplace at any time without prior warning.

About the Globashare Marketplace

Globashare marketplace is made up of 5 different types of Buying and Selling.

  1. Product Share Pages - Selling a product or finished item at a given price
  2. Service Share pages - selling fixed and tiered price services
  3. Subscription Share pages - Selling a subscription
  4. Pre-Sale Share pages - Pre-selling5.Freelancing by Milestone

Product Share Pages - About selling a product or finished item

Selling a Product on Globashare allows users to offer ready products for sale at fixed prices. Once a seller has created a Service share page, users may freely promote the page around the world wide webGlobashare is about original and quality work - Only the best sellers and items pass our review process. This way we make sure that all products on Globashare’s marketplace meet our quality standards.
Detailing your work adding tags and attributes
All uploads to Globashare must be well described, highlighting key features - and that tags and metadata are accurate and complete. An item’s metadata includes attributes such as: software version, number of files, duration, sizes, resolutions, frame rate, file size, alpha channel and loops, fonts etc.Offerings that are clearly out of date or offer a degraded experience may be removed from the marketplace at any time without prior warning.

Service Share pages - Selling fixed & tiered price services

Selling a fixed & tiered price service on Globashare allows users to offer Services for sale with predefined prices.Once a seller has created a Service share page, users may freely promote the page around the world wide web
Service share page – work flow orders and delivery
When purchasing from a Service Share page, buyers are prompted to click the “Buy” button on a given share page to initiate a purchase. Buyers will then be forwarded to a “Job Work Space” to submit “required information” pertinent to initialising their purchase. Once the “required information” has been submitted, the seller (share page owner) will be alerted to accept or declined the purchase request. If the seller accepts the request the Buyer will be prompted to fund the purchase - officially starting the job.

  • Failure to respond to Buyer requests within 4 days renders the job request terminated
    • Once a payment is confirmed, orders are given a unique order number.
    • Service Share Page sellers must deliver completed files and/or proof of work using the “Deliver Order” button located on the Job Work Space.
    • Using the “Deliver Order” button may not be abused by sellers to circumvent Order guidelines described in these User Terms. Using the “Deliver Order” button when an order was not fulfilled may result in a cancellation of that order after review, affect the seller’s rating and result in a warning to seller.
    • We encourage our buyers and sellers to try and settle conflicts amongst themselves, including by using the Self Resolution Centre activated by using the Submit Dispute Button. If for any reason this fails, users can contact Globashare's customer support department for assistance

    Handling Orders

    • When a buyer orders a Service, the seller is notified by email as well as notifications on the site while logged into the account.
    • Sellers are required to meet the delivery time they specified when creating their Share Pages. Failing to do so will allow the buyer to cancel the order when an order is marked as late and may harm the seller's rating.
    • Sellers must send completed files and/or proof of work using the “Deliver Order” button (located on the Job Work Space page) to mark the order as Delivered.
    • Users are responsible for scanning all transferred files for viruses and malware. Globashare will not be held responsible for any damages which might occur due to site usage, use of content or files transferred.
    • A Seller may cancel an order without the buyer's consent at any given moment (Force Cancellation). However, this will Raise a dispute, freezing all payments, until Globashare’s Dispute resolution team arbitrate the cancelation. Cancelling orders without a buyer’s consent may have a negative effect on the seller's rating.
    • Buyers may use the "Request Modifications" feature located on the Job Work Space page while an order is marked as Delivered if the delivered materials do not match the seller's description on their Share Page or the requirements sent to the seller at the beginning of the order process.

    Subscription Share page - Selling a Subscription

    Selling a Subscription on Globashare allows users to sell information and content charging a monthly subscription fee.Once a seller has created a Service share page, users may freely promote the page around the world wide web Globashare is about original and quality work - Only the best sellers and items pass our review process. This way we make sure that all products on Globashare’s marketplace meet our quality standards.

    Seller

    • Subscriptions on Globashare are purchase at a fixed fee and are billed monthly – Globashare will adjust re-accruing payments falling on the 29-31 to the 1st of each month
    • Subscription share pages are either accessed free of charge, with the possibility of adding a “donate” button or by paying a monthly access price – assigned buy the seller
    • Subscription share pages are sold by edition, each edition can be configured to last up to 12 months - and extended by a further 12 months, indefinitely.
    • Extension of the duration of subscriptions can only happen 2 months prior to the end of existing subscriptions.
    • IMPORTANT: Changing the price of a subscription while extending your subscription will result in your existing subscribers becoming immediately un-subscribed, forfeiting any future revenues and requiring subscribers to re-subscribe at their discretion.
    • Sellers may cancel their subscription service at any time – cancelation of Subscription share pages while there are active subscribers will result in unreleased funds being returned to the subscribers
    • Sellers receive funds from their paying subscribers 14 days at the end of each month withholding cancelled subscriptions

    Sellers must deliver must their subscription “as described” by the seller on their share page description. Failure to do so could result in complaints from “subscribers” and result in the termination of the share page and closure of the seller’s Globashare account.

    Buyers

    • Subscription Share Pages are accessed, sold and subscribed to, by default, on a monthly basis. Globashare will adjust re-accruing payments falling on the 29-31 to the 1st of each month.
    • Subscription share pages are either accessed free of charge, with the possibility of donating funds through an optional donation button or by paying a monthly access price – both assigned buy the seller
    • Buyers may cancel subscriptions at any time.
    • Buyers of subscriptions who are unsatisfied with a subscriptions delivery are encouraged to:
      • Check the share page’s description to review the subscriptions terms before
      • Contacting the seller to resolve their complaint – if still unsatisfied subscribers may;
      • Contact Globashare to “Report” the subscription share page – by clicking on the report button on the seller’s subscription share page.
    • When a buyer cancels a subscription - they should will just stop paying future months - existing funds will go to seller
    • If a seller changes the price the price of a subscription - all existing subscribers will have to re-subscribe

    Pre-Selling

    When you set up a pre-sale on Globashare Seller have two basic options

    1. To take orders on an item delivered at a given date in the future
    2. To sell an item requiring a minimum number of pre-orders before you start to deliver your project

    Sellers

    • Payments will be deducted from buyers when the seller has “delivered” their project, using the upload button on their share page.
    • Sellers receive funds from their buyers after a 14-day escrow period - after delivery of their product or project
    • Buyers may cancel orders at anytime

    Sellers must deliver must their product “as described” by the seller on their share page description. Failure to do so could result in complaints from “Buyer” and result in the termination of the share page and closure of the seller’s Globashare account

    Buyer

    • Payments will be deducted from buyers when the seller has “delivered” their project.
    • Funds are released to sellers 14 days after the seller has “delivered” their offering
    • Buyers may cancel orders at any time up until the seller has “delivered” their offering

    Freelance Centre

    The Freelance Centre on Globashare allows users to buy and sell freelance services. The freelance Section of Globashare is based on a Milestone system.
    This is where “Buyers” and “Sellers” agree to accomplish an a mutually defined “Agreement” based on a pre-arranged number of millstones, each tied to a set of pre-agreed “payments”.
    Both the number of “milestones” and “payment amounts” are decided by the buyer and seller.
    To launch a job, Buyers will post a “Job” brief to be review by Globashare review team.Once approved Freelancers or “Sellers” may submit an offer to complete the posted job.
    At the sole desecration of the “Buyer” - By clicking on the Hire button associated with a a freelancer’s offer - the Buyer may enter an agreement with the seller to complete the posted job

    Freelance Centre – workflow orders and delivery

    When hiring a freelancer, buyers are prompted to click the “Hire” button on a freelancer’s submitted offer to initiate a Freelance Job.
    Both the Buyer and Seller must form a mutually decided “Agreement” and acknowledge this agreement using the “Submit Agreement” and “Approve Agreement” Buttons.Both the Buyer and Seller may cancel the freelance job up until this point.The Buyer and Seller officially enter a contract when the Buyer funds the first milestoneFailure to fund a milestone within 4 days renders the job request terminated

    • Once a payment is confirmed, orders are given a unique order number.
    • Freelancers sellers must deliver completed files and/or proof of work using the “Deliver Order” button located on the Job Work Space.
    • Using the “Deliver Order” button may not be abused by sellers to circumvent order guidelines described in these User Terms. Using the “Deliver Order” button when an order was not fulfilled may result in a cancellation of that order, and after review affect the seller’s rating and result in a warning to seller.
    • An order is marked as complete after a milestone’s funds have been released.

    Handling Freelance Jobs

    • When a buyer orders a Freelance Job, the seller is notified by email as well as notifications on the site while logged into the account.
    • Sellers are required to meet the delivery time they specified when creating their Freelance Job Agreements. Failing to do so will allow the buyer to cancel the order.
    • Sellers must send completed files and/or proof of work using the “Deliver Order” button (located on the Job Work Space page) to mark the order as Delivered.
    • Users are responsible for scanning all transferred files for viruses and malware. Globashare will not be held responsible for any damages which might occur due to site usage, use of content or files transferred.
    • A Seller may cancel an order without the buyer's consent at any given moment (Force Cancellation).     Fees and Pricing

    BUyers

    Service fees are added at the time of purchase where a buyer can review and accept the total amount requested to pay. These fees cover administrative fees.

    Seller

    Depending on your membership status, sellers pay the following commission on their sales

    Taxes

    • Buyers may be charged with indirect taxes (such as VAT or GST) depending on their residency, location and any applicable law, in addition to the price shown on the Share Page.
    • Buyers agree that they are responsible to comply with all tax requirements applicable to them, including but not limited to any obligation to deduct or withhold taxes. It is hereby clarified that all prices and fees that appear on the Site are the net amounts that will be paid to Globashare following any direct or indirect taxes, levy, withholding tax and/or deductions.
    • Sellers are responsible for paying any direct or indirect taxes, including any GST, VAT or otherwise, which may apply to them depending on residency or location. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The price shown on a share page or freelance job is inclusive of all such taxes and charges that may apply to the Sellers.

    Payment protection and refunds

    Payment Protection

    Globashare’s systems are built to promote “Trust and Reliability”. All payments for items, services and all things sold on Globashare are protected by a 14 day escrow system. This means that all funds paid to Sellers are held for 14 days allowing Buyers sufficient time to verify their product.

    Should Buyers find that their purchase is not what was claimed or agreed upon, they are prompted to:

    1. Raise a Dispute – in the case of Freelance Jobs and Service Share Pages. This can be done from the Job Work Space
    2. Submit a Report – in the case of marketplace items, including Products, Subscriptions and Pre-Sales. This can be done from the items’ share page, by clicking on the report button

    Raising a Dispute or Submitting a Report will connect Buyers with Globashare’s Dispute resolution team how will review claims. See below information regarding Refunds.

    Refunds

    Before claiming a refund please make sure you have:

    • Read the documentation on the share page where you made purchase
    • Check the item's or seller’s comments, as you may find a solution to your issue
    • We encourage our users to communicate and resolve disputes using the Contact button on the items Share page or the message boxes found in the Job Work Space of freelance jobs or Service share Pages
    • Ensure the item is being used for its intended function and is compatible with your intended application

    Globashare does not automatically refund payments made for cancelled orders back to your payment provider. Funds from order cancellations are refunded to the buyer's balance as credit and are available for withdrawal to your preferred withdrawal method or to for future purchases on Globashare. Funds returned to your balance from cancelled orders will still include service fees paid.

    Deposit refunds, when available from the payment provider, can be performed by our Customer Support team. To prevent fraud and abuse, we limit the total amount of times users can request a payment provider refund from their account which is subject to review by our Customer Support team. Such refunds may be subject to an additional fee. If any service fees were added at the time of purchase to create a new order, the service fees from that payment will not be refunded along with your deposit.

    Refunds from Marketplace Sellers

    For creators and owners of the items for sale on Globashare Marketplace, each Share Page Owner / Author is responsible for their items. These rules are based on consumer laws that we think are the best “baseline” to apply to transactions that happen on Globashare Marketplace, so that buyers have a consistent experience and know what to expect from all sellers. Please note that in addition to these rules, each country has its own laws surrounding refunds, and these local laws are not excluded if they apply to you.
    Here are the situations in which we expect refund to be approved on an items and related services you have purchased.

    Why we grant refunds

    Globashare Customer Support will cancel orders based on, but not limited to, the following reasons:

    1. Item is "not as described" - An item is "not as described" if it is materially different from the item description or preview so you should expect the author to "tell it like it is" when it comes to the features and functionality of items. If it turns out the item is "not as described" you will be entitled to a refund.
    2. Item doesn't work the way it should - If an item doesn't work the way it should and can't easily be fixed you are entitled to a refund of the item. This includes situations where the item has a problem that would have stopped you from buying it if you'd known about the problem in the first place. If the item can be fixed, then the author is required to do so promptly by updating the item otherwise you are entitled to a refund of that item.
    3. Item has a security vulnerability - If an item contains a security vulnerability and can't easily be fixed you are entitled to a refund of the item. If the item can be fixed, then the author should do so promptly by updating the item. If the item contains a security vulnerability that is not patched in an appropriate timeframe then you are entitled to a refund of that item.
    • General misconduct, such as harassment, unlawful behaviour. Users are abusive towards the other party, which includes threats of low ratings or using personal information against each other.
    • The user is no longer an active Globashare user due to Terms of Service violations or closure of their account.
    • Users who have been reported to use copyright/trademark infringing materials after verification and with proof.

    Why a refund may not be given

    If the item is materially similar to the description and preview and works the way it should, there is generally no obligation to provide a refund in situations like the following:

    • you don't want it after you've downloaded it;
    • the item did not meet your expectations;
    • you simply change your mind;
    • you bought an item by mistake;
    • you do not have sufficient expertise to use the item;
    • you ask for goodwill; or
    • you can no longer access the item because it has been removed (we advise you to download items as soon as you have purchased them to avoid this situation).
    • Orders are not eligible to be cancelled based on the quality of service/materials delivered by the seller if the service was rendered as described on the share page or the freelance agreement you have made.

    What if an item is no longer available?

    If the share page item is no longer available, please contact support@globashare.com

    To request a refund - Click File Raise Dispute on your Job Work Space page or Report on a Share Page

    If you and the other party can't come to solution about your work you may request a refund by clicking on the Raise dispute button found in the active job space of your corresponding Freelance Job or Service Share Page or report found on all share pages
    Once a dispute or report is filled – you will be contacted by Globashare usually within 72 hrs
    Note Globashare’s refund resolutions are binding - and as part of using Globashare you agree that our decision is final and irrevocable.

    Withdrawing Revenues

    To withdraw your revenue, you must have an account with at least one of Globashare’s withdrawal methods.
    Your Globashare profile can be associated with only one account from each Globashare withdrawal methods. A withdrawal provider account can be associated with only one Globashare profile.

    Revenues are only made available for withdrawal from the Money & Transactionspage following a safety clearance period of 14 days after the order is marked as complete.

    • To withdraw your available revenue, you must click on the designated withdrawal provider to initiate the withdrawal process.
    • Withdrawals can only be made in the amount available to you.
    • Withdrawal fees vary depending on the withdrawal method.
    • Withdrawals are final and cannot be undone. We will not be able to refund or change this process once it has begun.
    • Currency conversion costs - You are responsible for all costs of currency conversion relating to your Globashare buying and selling activity. Your financial institution does the currency conversion and may charge you additional fees (we don’t control either the conversion rates or your financial institution’s fees).

    Customer Reviews:

    We encourage users to:

    • Leave ratings and reviews that are honest, respectful and constructive.
    • Try to resolve any issues with the author before leaving a negative rating and review.

    Buyer and seller reviews are an integral part of Globashare experience, so users should treat customers with respect when responding to their comments. Keep responses targeted to the user’s comments and do not include personal information, spam, or marketing in your response.
    Globashare’s default position is not to censor, edit, or delete ratings or reviews by buyers.
    There are rare cases where we may take the step of removing a rating or review. If there are repeated or severe violations by a buyer, we may even suspend the buyer or cancel their account. We have the last say on whether a rating or review violates this policy.

    What is not permitted

    • Ratings and reviews that aren’t about the item or author but that focus purely on something or someone else. "Item" here refers to all aspects of the item including but not limited to its perceived value, listing, documentation, etc.
    • Reviews that are obscene, defamatory, threatening or discriminatory.
    • Reviews that violate someone’s privacy rights (such as publishing someone’s name, address or other identifying information without their permission).Ratings and reviews that attempt to force a user to do something they aren’t obligated to do.

    Upgrading and membership tiers

    Once a user register to become a member of Globashare they enter a membership tier.
    Those membership tiers are the following:

    • Regular
    • Bronze
    • Silver
    • Gold

    Each of the membership tiers has certain privileges associated with each tier.

    Those privileges include:

    Fast Share Page Authorization – where a user’s submissions to Globashare’s authorization team will have a fast track review
    Number of share pages allowed – users are limited to the number of share pages they are allow to create depending on their membership tier
    Pricing Cap - Users ability to price their item are limited by their membership tier
    Marketplace presence – A users’ marketplace presence frequency and positioning, i.e. the number of times they appear, as well as how high up on a Globashare marketplace search result, a user’s share page tile appears
    Sales Commission – Users’ pay different levels of sales commission depending on their level of membership
    Storage – Depending on a user’s level of membership, users’ will be assigned varying levels of storage space on Globashare’s servers for their uploaded media intended for sale. Excluded media includes, media exchanged within freelance jobs, Service Share Pages, and site-wide messaging
    Globashare reserves the right to alter and change the features and values on their Upgrading and membership tiers.
    Upgrade plans for membership tiers last 1 year from the point of upgrade purchase.

    Currencies

    Currency conversion costs: You are responsible for all costs of currency conversion relating to your Globashare buying and selling activity. Your financial institution does the currency conversion and may charge you additional fees (we don’t control either the conversion rates or your financial institution’s fees).

    Note to freelancers and creative agencies:

    Freelance Jobs and Service Share pages - Ownership and limitations:

    In Freelance Jobs and Service Share pages unless clearly stated when the work is delivered and subject to payment, the buyer is granted all intellectual property rights, including but not limited to, copyrights for the work delivered from the seller and the seller waives any and all moral rights therein.
    The delivered work shall be considered work-for-hire under the U.S. Copyright Act. In the event the delivered work does not meet the requirements of work-for-hire or when US Copyright Act does not apply, the seller expressly agrees to assign to buyer the copyright in the delivered work.
    All transfer and assignment of intellectual property to buyer shall be subject to full payment for the job and the delivery may not be used if payment is cancelled for any reason.
    Sellers further confirm that whatever information they receive from the buyer, which is not public domain, shall be kept confidential and shall not be shared or used for any purpose whatsoever other than for the delivery of the ordered work to the buyer.
    Furthermore, users (both Buyers and Sellers) agree that unless they explicitly indicate otherwise, the content users voluntarily create/upload to Globashare, including texts, photos, videos, usernames, user photos, user videos and any other information, including the display of delivered work, may be used by Globashare for no consideration for marketing and/or other purposes.

    Intellectual Property

    What we own: We own all the Globashare Content that we have put on Globashare.com (unless otherwise stated and excluding content owned by others). This includes the design, compilation, and look and feel of the Globashare site, and copyright, trademarks, designs and other intellectual property on Globashare. We own all the trademarks, logos, service marks and trade names on Globashare (unless otherwise stated and excluding these things owned by others). You will not copy, distribute, modify or make derivative works of any of our Globashare Content or use any of our intellectual property in any way not expressly stated in these terms.

    What we don’t own: We do not own the Items and services for sale on Globashare; the Item authors, buyers and sellers produce and upload.

    Copyright, trademark and intellectual property claims: We respect the intellectual property rights of others. If you believe that an Item or any content on Globashare infringes any intellectual property right (including copyright) please see the information in our Intellectual Property Policy.

    Our Intellectual Property Policy is where you will find all the information relating to how we treat intellectual property on Globashare including copyright and other rights.

    Our use of your information

    Privacy: We respect your privacy and process your information in accordance with our Privacy Policy.

    Confidential Information

    We value your information and take reasonable precautions to protect it. While using Globashare, you may also become aware of confidential information about us, or someone else. You promise to not disclose any confidential information made available to you through Globashare to any other person.

    Legal Housekeeping

    Eligibility, suspension or termination: Being a member of Globashare is not an automatic right, it is a benefit for those who follow our reasonable rules. We hope that you will be with us for a long time. But we may, using reasonable discretion, decide whether or not your use of Globashare complies with these terms. We can suspend or terminate your subscription account at any time for any reason (acting reasonably of course) including:

    • if you breach these terms;
    • if you act in a way that does not align with the values of our community; or
    • if you act in a way that could cause us or others harm.

    If we do decide to permanently terminate your Globashare account you must not apply for a new account as unfortunately you will no longer be welcome in our community.

    Globashare Companies: If an indemnity, limitation or disclaimer of liability, promise or release (a ‘benefit’) is given in our favour in these terms we hold that benefit on trust for the other Globashare Companies. We may enforce that benefit as trustee for and on behalf of the other Globashare Companies as beneficiaries under that trust.We may use the services of another Globashare Company to collect payment or carry out other activities with you to bring you Globashare.

    Availability

    We strive to have Globashare available to you 24 hours a day, seven days a week but you know how the internet works: occasionally you might not be able to access Globashare, and this might happen for any reason, at any time, with or without notice, or at our absolute discretion. We might also change aspects of how Globashare works, including the kinds of Items available on Globashare. The Globashare will not be liable to you for any loss you suffer as a result of these things.

    Third parties

    If you’re agreeing to these terms on behalf of someone else then you’re promising to us that you have full legal authority to bind that third party. Remember that only real people can subscribe to Globashare.

    Consumer laws

    In some places there may be non-excludable warranties, guarantees or other rights (‘non-excludable consumer guarantees’). We do not exclude, restrict or modify non-excludable consumer guarantees in these terms. Except for non-excludable consumer guarantees, we are bound only by the express promises made in these terms. Our liability for breach of a non-excludable consumer guarantee is limited, at our option, to replacing or paying the cost of replacing the relevant Item or service, (unless the non-excludable consumer guarantee says otherwise). You must not use an Item in violation of any export laws that apply to you.

    Blocking you, disabling your subscription or refusing to process a payment: We may block you, terminate your subscription or refuse to process a payment if we reasonably believe there is a risk associated with you, your subscription, or that payment, including if it breaches a law or regulation. Examples of where we might do this include transactions where the payment is from or to a person or country sanctioned by an authority (like the United Nations, the United States government or the United Kingdom government); or where we reasonably believe there is a legal or regulatory risk or a risk of loss being suffered by us or our members. You promise that you are not located in a sanctioned country and are not on a sanctioned persons list. We may also block members from a country if we can’t make payments to or from that country. You should check what payment methods are available in your country for making payments. We may take any of the actions stated in this section without notice and against all of your Globashare accounts you use on other Globashare sites. As our sites are global, there are different laws that may apply and these may restrict our relationship with you.

    US-specific controls

    Globashare is not available to anyone located in any U.S. sanctioned countries or to anyone on the U.S Treasury Department’s list of Specially Designated Nationals List (SDN list). You must not export or re-export Globashare Items to a U.S. sanctioned country or to anyone on the SDN list.

    Relationship between the parties:

    Nothing in these terms is to be construed as constituting a partnership, joint venture, employment or agency relationship between users’ of Globashare and Globashare Ltd, or between you and any other member. Neither users’ nor Globashare Ltd can bind each other in any way.

    Notices

    Any notice you send us must be submitted via a help request. Any notice we send to you will be emailed to the email address you provided to us.

    Changes to these terms

    We may change these terms at any time and, if we make changes, we will take reasonable steps to let our Subscribers know about the changes. You can also keep track of whether changes have been made to our terms by referring to the version and effective date at the footer of the terms. If a change we make has a material effect on you to your detriment then you may, upon demonstrating that detriment to us, cancel your Globashare subscription. However, if you continue to use Globashare after the changes are made, then you will be agreeing to the changes regardless of the amount of time which has elapsed. Whether a change has a material effect on you to your detriment depends on the nature of the change and your particular circumstances. For example, a change which causes you to incur increased transaction fees, or which removes an entire category of Items, could have a material effect on the amount of value you get out of Globashare. The removal of individual items or a minor clarifying change to the Globashare will not typically have a material effect on you to your detriment.

    Interpretation

    Words like ‘include’ and ‘including’ are not words of limitation and where anything is within our discretion we mean our sole discretion.

    Applicable Laws

    We control and operate Globashare from our offices in the United Kingdom. The laws of United Kingdom govern these terms, and you submit to the jurisdiction of the courts there for the resolution of any dispute between us.

    Limitation on Liability

    IN NO EVENT WILL GLOBASHARE, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
    THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
